Terms of Service

Effective date: 20 September 2026 · Last updated: 20 September 2026

These terms are a binding agreement between you and ByteMind. Please read them before using the website at bytemind.work or the ByteMind application.

1. Acceptance of these terms

By accessing the ByteMind website, creating an account in the ByteMind application, or otherwise using our services, you agree to these Terms of Service and to our Privacy Policy, which is incorporated into these terms by reference.

If you do not agree to these terms, do not use the website or the application. If you are agreeing on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

2. Who we are

ByteMind (“ByteMind”, “we”, “us” or “our”) is a sole proprietorship. You can reach us at contact@bytemind.work.

3. What these terms cover

These terms govern:

  • your use of the bytemind.work website, including its informational content and contact form; and
  • your use of the ByteMind application, including sign-in with Google.

These terms do not govern paid consulting work. See section 10.

4. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our services. Our services are intended for business use and are not directed at children.

You may not use our services if you are barred from doing so under applicable law, including trade sanctions and export control laws.

5. Accounts and Google sign-in

The ByteMind application uses sign-in with Google. When you sign in, we receive your name, email address, profile picture and Google Account identifier, as described in our Privacy Policy. We never receive your Google password.

You are responsible for:

  • maintaining the security of the Google Account you use to sign in;
  • all activity that occurs under your account; and
  • notifying us promptly at contact@bytemind.work if you believe your account has been accessed without authorisation.

You may revoke our access at any time from your Google Account permissions page, and you may ask us to delete your account data as described in the Privacy Policy. Do not share your account with others or let anyone else use it.

6. Acceptable use

You agree not to:

  • use the services for any unlawful purpose, or in violation of any applicable law or regulation;
  • attempt to gain unauthorised access to the services, other users’ accounts, or any connected system or network;
  • probe, scan or test the vulnerability of the services, or breach or circumvent any security or authentication measure, other than under a written authorisation from us;
  • interfere with or disrupt the services, including by overloading, flooding or sending automated traffic at a rate that degrades service for others;
  • scrape, harvest or bulk-download content from the services by automated means, other than search engine indexing consistent with our robots.txt file;
  • reverse engineer, decompile or disassemble any part of the services, except to the extent that restriction is prohibited by applicable law;
  • resell, sublicense or otherwise commercially exploit the services without our written permission;
  • use the contact form to send spam, chain messages, advertising or bulk solicitations;
  • upload or transmit malware, or any code designed to damage or interfere with software or hardware;
  • impersonate any person or organization, or misrepresent your affiliation with one;
  • remove, obscure or alter any copyright, trademark or other proprietary notice.

We may investigate and take appropriate action against anyone who violates this section, including removing content, suspending access and reporting the matter to law enforcement.

7. Intellectual property

The services, including the website design, text, graphics, logos, and the software behind ByteMind, are owned by ByteMind or its licensors and are protected by copyright, trademark and other laws. The name “ByteMind” and the ByteMind logo are our trademarks; you may not use them without our prior written permission, except to refer to ByteMind fairly and accurately.

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the services for your own internal business purposes. All rights not expressly granted are reserved.

8. Your content

You retain ownership of any content you submit through the services, including the contents of enquiries you send us. You grant us a limited license to use, store and reproduce that content solely to operate the services and to respond to you.

You are responsible for the content you submit, and you represent that you have the rights to submit it and that it does not infringe anyone else’s rights or violate any law.

If you send us suggestions, feature requests or other feedback, you agree that we may use it without restriction or obligation to you. Please do not send us confidential information through the contact form; use a signed non-disclosure agreement first, which we are glad to put in place.

9. Third-party services

The services rely on third parties, including Google for authentication, Microsoft Azure for hosting, and Web3Forms for contact form delivery. Your use of sign-in with Google is also governed by the Google Terms of Service and the Google Privacy Policy.

We are not responsible for third-party services, their availability, or their terms. Links from our website to other sites are provided for convenience and are not an endorsement.

10. Consulting engagements

These terms do not create any obligation to perform paid work, and they are not the contract for it. Consulting, development and advisory services are provided only under a separate written agreement signed by both parties, covering scope, deliverables, timeline, fees, confidentiality, intellectual property assignment, warranties and liability.

Nothing on the website — including descriptions of services, indicative engagement lengths and the contents of any proposal marked as a draft — is an offer capable of acceptance, a quotation, or a guarantee of availability, results or timelines. Where a signed engagement agreement conflicts with these terms, the engagement agreement controls for that work.

11. Fees and availability

The bytemind.work website is free to use. The ByteMind application is in active development and is currently provided without charge to invited users; it may be unavailable, may change substantially, and may contain defects.

If we introduce paid plans for ByteMind, we will publish pricing and payment terms before you are asked to pay anything, and paid features will not be enabled without your agreement.

We may modify, suspend or discontinue any part of the services at any time. Where we discontinue a service that holds your data, we will give reasonable advance notice by email and a means of exporting your data where practical.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the services will be uninterrupted, secure, error-free or free of harmful components, or that any defect will be corrected. You are responsible for maintaining your own backups of any data important to you.

Content on the website is provided for general information only. It is not professional, legal, financial or security advice, and you should not act on it without obtaining advice specific to your circumstances.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BYTEMIND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).

These limitations apply to the website and to the ByteMind application. Liability arising from a signed consulting engagement is governed by that engagement agreement instead. Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for fraud, wilful misconduct or death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless ByteMind from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your misuse of the services, your violation of these terms, your violation of any law, or your infringement of a third party’s rights. We will notify you of any such claim and may participate in its defense at our own expense.

15. Termination

You may stop using the services at any time, revoke our access to your Google Account, and ask us to delete your account data.

We may suspend or terminate your access to the services at any time, with or without notice, if you breach these terms, if we reasonably believe your use creates risk or legal exposure, or if we discontinue the service. Where circumstances allow, we will give notice first.

Sections 7, 8, 12, 13, 14, 16, 17 and 19 survive termination, along with any other provision that by its nature should survive.

16. Disputes

If you have a problem, contact us first at contact@bytemind.work. We will try in good faith to resolve it informally, and most issues are resolved this way.

If we cannot resolve a dispute informally within 60 days of your written notice, either party may pursue the matter in the courts identified in section 17. These terms do not require binding arbitration, and neither party waives the right to seek injunctive relief to protect its intellectual property or confidential information.

17. Governing law and venue

These terms and any dispute arising out of them are governed by the laws of the State of New Jersey and the federal laws of the United States, without regard to conflict-of-law rules.

You and ByteMind agree that the state and federal courts located in New Jersey have exclusive jurisdiction over any dispute arising out of these terms, and each party consents to personal jurisdiction and venue in those courts. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your place of residence.

18. Changes to these terms

We may update these terms as the services develop or as the law requires. When we do, we will revise the “last updated” date at the top of this page. If a change is material, we will give reasonable advance notice by email to registered users or by a prominent notice on the website before it takes effect.

Continuing to use the services after a change takes effect means you accept the revised terms. If you do not accept them, stop using the services and ask us to delete your account.

19. General terms

  • Entire agreement. These terms and the Privacy Policy are the entire agreement between you and ByteMind regarding the website and ByteMind, and they supersede any prior understanding on that subject.
  • Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
  • No agency. These terms do not create a partnership, joint venture, employment or agency relationship between you and ByteMind.
  • Force majeure. Neither party is liable for a failure to perform caused by events beyond its reasonable control.
  • Notices. We may give notice by email to the address associated with your account or by posting on the website. You give notice to us at contact@bytemind.work.
